The author attempted to present the development of legal theories through early & medieval philosophical history.

Here I examine Bernard Suits’s definition of games and explain why that definition is in need of reference to representation or, put more generally, to semiosis. And, once admitting the necessity of the representational in games, Suits’s definition must also then admit the essential paradoxy of games.

Today, any credible philosophical attempt to discuss personhood must take some position on the proper relation between the philosophical analysis of topics like action, intention, emotion, normative and evaluate judgment, desire and mood --which are grouped together under the heading of `moral psychology'-- and the usually quite different approaches to ostensibly the same phenomena in contemporary theoretical psychology and psychoanalytic practice. The gulf between these two domains is so deep that influential work in each takes no direct account of developments (...) in the other. I believe that there is much to be learned about dominant and often hidden assumptions in contemporary approaches to personhood by comparisons between these fields, but at the outset I want to distinguish this intuition from another one in vogue among philosophers working to bridge the gap between philosophical and psychological disciplines today. This is the somewhat positivist sense that philsophical investigation must take its starting-points and limits from well-established psychological findings, and that philosophical accounts at odds with these are for that reason unrealistic, or obviously trading on outmoded and scientifically discredited `folk metaphysics.' For example, this sense that philosophy must acknowledge its secondary position relative to empirical psychology is implicit throughout Bernard Williams's work on motivation and morality, and it is the explicit basis of Owen Flanagan's recent attempt to limit ethical theory by `psychological realism' and argue for a form of relativism by "[a]ttention to psychological facts." Because all modern conceptions of morality are committed to making "our motivational structure, our personal possibilities, relevant in setting their moral sights," they cannot be developed without. Background Despite the growth of biomedical research in South Africa, there are few insights into the operation of Research Ethics Committees (RECs) in this setting. We investigated the composition, operations and training needs of health RECs in South Africa against the backdrop of national and international guidelines. Methods The 12 major health RECs in South Africa were surveyed using semi-structured questionnaires that investigated the composition and functions of each REC as well as the operational issues facing committees. Results Health RECs (...) in SA have an average of 16 members and REC members are predominantly male and white. Overall, there was a large discrepancy in findings between under-resourced RECs and well resourced RECs. The majority of members (56%) are scientists or clinicians who are typically affiliated to the same institution as the health REC. Community representatives account for only 8% of membership. Training needs for health REC members varied widely. Conclusion Most major health RECs in South Africa are well organized given the resource constraints that exist in relation to research ethics in developing countries. However, the gender, racial and occupational diversity of most of these RECs is suboptimal, and most RECs are not constituted in accordance with South African guidelines. Variability in the operations and training needs of RECs is a reflection of apartheid-entrenched influences in tertiary education in SA. While legislation now exists to enforce standardization of research ethics review systems, no provision has been made for resources or capacity development, especially to support historically-disadvantaged institutions. Perpetuation of this legacy of apartheid represents a violation of the principles of justice and equity. (shrink)

In recent years more support has been given to the idea of Health Education and there are strong reasons for believing that such schemes of prevention may receive much more financial backing from governments. It is being realised, also, that many of our 'ills' may be attributed to an over-reliance on medical technology. There is reason to believe that in years to come the emphasis will be placed on the fostering of mental health in programmes of Health Education enabling the (...) individual to take a responsible attitude in learning how to seek out health hazards for himself without over-reliance on others. Philosophers have argued that stakes affect knowledge: a given amount of evidence may suffice for knowledge if the stakes are low, but not if the stakes are high. By contrast, empirical work on the influence of stakes on ordinary knowledge ascriptions has been divided along methodological lines: “evidence‐fixed” prompts rarely find stakes effects, while “evidence‐seeking” prompts consistently find them. We present a cross‐cultural study using both evidence‐fixed and evidence‐seeking prompts with a diverse sample of 17 populations in 11 countries, speaking (...) 14 languages. Our study is the first to use an evidence‐seeking prompt cross‐culturally, and includes several previously untested populations (including indigenous populations). Across cultures, we do not find evidence of a stakes effect with our evidence‐fixed prompt, but do with our evidence‐seeking prompt. We argue that the divergent results reveal a tension within folk epistemology: people's beliefs about when it is appropriate to ascribe knowledge differ significantly from their actual practice in ascribing knowledge. While “inclusion” has been seen as a central mode of redressing ongoing injustices against communities of color in the US, Indigenous political experiences feature more complex legacies of contesting US citizenship. Turning to an important episode of contestation, this essay examines the relation between inclusion and the politics of eliminating Indigenous nations that was part of a shared policy shift toward “Termination” in the Anglo-settler world of the 1950s and 1960s. Through a reading of Indigenous activist-intellectual Vine Deloria Jr.’s Custer (...) Died for Your Sins: An Indian Manifesto (1969), it demonstrates how the construction of what I call the “civic inclusion narrative” in post–World War II American political discourse disavowed practices of empire-formation. Widely considered a foundational text of the Indigenous Sovereignty Movement, the work repositioned Indigenous peoples not as passive recipients of civil rights and incorporation into the nation-state but as colonized peoples actively demanding decolonization. Deloria’s work provides an exemplary counterpoint to the enduring thread of civic inclusion in American political thought and an alternative tradition of decolonization—an imperative that continues to resonate in today’s North American and global Indigenous struggles over land, jurisdiction, and sovereignty. This essay asks why Aristotle, certainly no friend to unlimited democracy, seems so much more comfortable with unconstrained rhetoric in political deliberation than current defenders of deliberative democracy. It answers this question by reconstructing and defending a distinctly Aristotelian understanding of political deliberation, one that can be pieced together out of a series of separate arguments made in the Rhetoric, the Politics, and the Nicomachean Ethics.

Hannah Arendt’s account of imperialism has become an unlikely source of inspiration for scholars invested in anti-colonial and postcolonial critique. However, the role of settler colonialism in her thought has come under far less scrutiny. This essay reconstructs Arendt’s account of settler-colonization. It argues that Arendt’s republican analysis of imperialism hinges on her notion of the boomerang effect, which is absent in settler-colonial contexts. Arendt recognized some of the distinctive features of settler expansionism but reproduced many of the ideologies that (...) sustain practices of settler-colonial conquest. This interpretation sheds light on the promises and limits of contemporary retrievals of Arendt’s analysis and critique of imperialism by foregrounding the specificity of settler colonialism as an axis of ongoing colonial violence. Environmental journalism has been criticized by various special interest groups and some editors for advocacy and faulted for inaccuracies. Sources, in turn, many from the science communities, have been accused of inaccessibility, and public relations representatiws from both industry and environmental organizations are regularly blamed for unethical behaviors rangingfrom hyperbole to more serious discussion or omission of factual information. This article reports a preliminary study of ethical decision making among members of the Society of Environmental Journalists, identifying ethical motivation diljerences (...) using the Ethical Motivation Scale. The implications of the reported dominant extrinsic guides are discussed in light of a proposed protocol for ethical environmental communication. (shrink)

This chapter leads the readers from technology and philosophy to biology and sociology on the basis of the notion of information as well as communication, aims to make clear. The paradigm of Information concerns all the branches of physics and plays a prominent role in quantum dynamics as well as cosmology, interpreting Gravity as the uncovering of an informational order in the universe. In the chapter, Information with a capital I represents an issue of a cultural and political order faced (...) by the 21st Century, besides constituting a philosophical challenge. The philosophy of Information completes the philosophy of Technology. Men have to determine two essential components, namely technological activity and the conscience emerging with inputs of information that organizes itself and is reflected. To conclude the general presentation of a "philosophical path" for the 21st Century, the chapter discusses the fundamental structure that links Technology and Information while also distinguishing between them. This paper considers how a Shi’a Islamic perspective of wisdom can inform contemporary business ethics theory. Given the growing business ethics literature that adopts an Islamic orientation, it is vital that Islamic tenets in a business context are established. Thus, this paper thoroughly researches the tenets of Shi’a wisdom theory using a hermeneutic analysis, guided also by Iranian theological scholars of ancient Persian and Arabic foundational texts, to provide a comprehensive explanation of the foundations of Shi’a faith relevant to business (...) ethics. Having established the principles of Shi’a wisdom, we outline points of consonance and dissonance in comparison to the Western humanist, primarily Aristotelian, orientations to wisdom. Although identifying apparently irreconcilable differences, this analysis reveals important elements of Shi’a wisdom theory that can significantly invigorate and influence business ethics theory. This paper takes up the question, “What is the responsibility of the philosopher, specifically the Catholic philosopher, in teaching ethics at a Catholic university?” Examination of the constitution Ex Corde Ecclesiae reveals that answering this question requires examining in turn the relationship between theology and philosophy. Accordingly, the paper proceeds to an analysis of the late Pope John Paul II’s encyclical, Fides et Ratio. Th is analysis shows, however, that the very distinction between theology and philosophy seems to become problematic (...) on the encyclical’s terms. The paper thus goes on to indicate a different means of distinguishing these disciplines, and concludes by considering the significance of this distinction for the question of the responsibility of the Catholic philosopher. Cette étude envisage les notions de sujet, d’individu et de personne dans une perspective d’anthropologie historique. La période considérée va de la disparition de l’Empire romain d’Occident à la mutation féodale, et son analyse est centrée sur la convergence de la culture savante – c’est-à-dire chrétienne – avec ce que nous pouvons savoir de la culture populaire à propos des trois notions précitées. Inaugurée par saint Augustin dans ses Confessions, l’émergence de la notion de personne coïncide avec l’oblitération du sujet (...) dans le De Trinitate de l’évêque d’Hippone. Cette conception rejoint celle du corps grotesque qui traverse la culture populaire de cette époque. Quant à l’individu, il n’apparaît durant toute la période considérée que sous la forme de l’individu particulier dans le cadre d’une individualité de types, et non sous celle de l’individu singulier propre à notre modernité. « Nous sommes embarqués », certainement ; le tout est de savoir comment. On peut bien invoquer une condition commune, qui est celle des habitants d’une planète exposée aux risques de transformations soudaines. Mais cela ne nous autorise pas à dire que cette condition est celle de l’inséparation. Ce qu’il y a d’inséparé entre les êtres est toujours localisé. Il correspond à ce que Gilbert Simondon appelle le « transindividuel ». L’inséparé, qui existe localement entre quelques êtres, est l’enjeu d’un (...) travail dialectique – un travail d’inséparation. Un travail qui se reconnaît à ceci qu’il permet d’abriter l’expérience d’un temps commun. L’existence même du temps commun est l’enjeu essentiel de la politique aujourd’hui, et la condition d’une action à la mesure de la situation. Car ce qu’impose avant tout l’ennemi aujourd’hui, c’est bien une certaine forme du temps, qu’il s’agit de briser. (shrink)
